Application For Independent Trustee Legal

Bakwena Ba-Mogopa Traditional Council hereby wish to invite eligible persons who wish to 
serve as Independent Trustees to make applications.

What is an Independent Trustee
An independent trustee is a person who cannot benefit from the income or assets of the trust, nor are they related to a beneficiary of the trust and can thus play a crucial role in the proper separation between ownership of the trust assets and the enjoyment thereof.

The Role of the Independent Trustees will be to

•Protectand take legal ownership of the assets held by the trust.
•Ensurethatthe trust operates in the interests of the beneficiaries and in compliance with the law.
-Act with independent discretion with respect to a trust.
-Account to the beneficiaries and provide them with proper and accurate accounts.
•Act strictly within the ambit of the powers conferred upon them by the trust.
•Be Knowledgeable about the business in which the trust operates.
-Performfiduciary duty to look after the trust assets in the beneficiaries' best interest.
•Ensure Proper records are kept in regard to trustee meetings (Meetings and Resolutions). •Ensure Investment of the trustcapital is undertaken in a prudent and professional manner.
•Ensure That the trustees disclose any potential conflict of interest.
•Manage any potential conflict in accordance with the trust instrument.
•Keeping the trustees abreast of any changes in the relevant legislation.
Ensure That The objectives of the trust are satisfied in accordance with the trust instrument.

Criteria for application

•South African Citizen Or Company. Space in between
NoCriminal Record.
•Five years' experience in managing trusts.
•LLB Degree (additional qualifications will be added advantage).
•Knowledgeable on fiduciary duties and responsibilities.
Understanding business in which the trust operates.
-Understand the laws governing trust.
